Kendrycks, Is He Eligible All Year?

Postby idhawkman » Mon Jul 29, 2019 3:22 pm

I have search the big I for any info on his case but the only thing I find is that the April 4 2019 sentencing date was postponed with no new sentencing date. Does anyone know if they are going to let this case just die or are they going to spring something on us after we start having a great season? Anyone else know what's going on with his case?

Well, that depends on the courts, but as far as the NFL is concerned, he was suspended last year for (4 ? ) games and that is it with them no matter the outcome of the court case.

He is looking at possible jail time if convicted, but, he could ask for a deferred sentence based on 'good behavior' for a few years, or for home confinement that allows him to 'work' or any of a number of ways not to serve any time right away. The fact that it's been 2 years now leads me to believe that he's not going to be sentenced to jail time. He may pay a fine, but he's already repaid the 'gain' -

Well, Pete expects him to be available all season, but with Pete, you always have to factor in the BS element as he's always painting a smiley face on any situation like this.

Kendricks has had his sentencing hearing postponed several times. The last postponement was indefinite, so who knows when we'll get a firm decision.

Totally agree with this.

I asked the question because I think they are wanting this to fade out of existence and also to kind of hold it over his head (the courts not the NFL) to keep on the straight and narrow. Kinda like a defacto probation because he probably knows that if he slips up and gets in trouble with the law again, this will be brought back to the foreground. I'm not sure what the statute of limitations are on a sentencing if any but if there isn't one, it acts as a lifelong probation for him.

I read a while back that the co-accused got a sentencing deferment so he could get a job.
If that's in fact what happened, it would suggest the sentence will not restrict Kendrycks ability
to work as well, which means no jail time.
Of course, it's all up to the Judge, and we don't know the minutiae of the case nor the Judge's
viewpoint on how paying back and cooperating mitigates sentencing parameters.

Yup, you're right about Kendrick's co defendant and the deal they gave him. If I recall, it was some sort of work release deal. But Kendrick's work release might be more complicated because of all the travel. But at least it shows the court's willingness to work with them.

I wonder how much the second chance bill and the lighter penalties for non-violent crimes has had on his sentencing.

I also wonder if the NFL suspension and lost wages associated with it factors into any sentence.

I'm sure his lawyer would make both of those points in an argument to the court for a workable agreement for him to pay his debt to society while keeping his career intact. The other thing is that Kendricks case has been a sort of advertising for the Feds in helping them fight this type of crime just like Robert Kraft's case has helped bring to light the human trafficking problem.

I believe the ultimate goal of the justice system is to levy punishment in proportion to the crime and to help reform/retrain the perpetrator into a contributing member of society (If possible). I believe that goal has been achieved in this case with the suspension, forfeiture of all ill-gotten gains, fines, etc. I don't believe Kendricks will commit this crime again - ever.

You're probably on the right track but he may get some community service where he talks to youth about choices in life.

I'm okay with that too. Part of the restitution phase of the corrective action.

Well, there you go. We have him until Sept 25th for sure and then it's up to the Courts. I still think he'll get probation and probably a suspended sentance if he stays out of trouble for X number of years.

I wonder what accounts for the long delay in sentencing? Justice delayed is justice denied.

If he played for the Rams or Patriots or Cowboys he would be a free man. Given he plays for the Seahawks the NFL will probably call the judge and make sure he does not play this season.

I came across a pretty good article that might explain why Kendrick's sentencing keeps getting delayed:

https://www.fieldgulls.com/2019/7/3/206 ... sentencing

Kendricks' childhood friend, Mark Wayne Ramsey, was also charge in the same case but plead guilty. It could be that the prosecution might be wanting Kendricks to cooperate and testify against him and might offer a reduced sentence in exchange for his cooperation. It could be that they want to keep Kendricks on the hook so he'll be willing to testify if Ramsey's case goes to trial.
